Participant Terms

• Tickets for the Event are subject to availability and only valid if acquired through our official registration channels. Registration for the Event is not confirmed until you receive a booking confirmation from us by email.
• Tickets are issued to the named ticket holder and are non-transferable and cannot be offered for resale unless we indicate otherwise.
• We reserve the right to decline or cancel any ticket registration at our discretion, including where we reasonably suspect misuse or fraudulent activity. A full refund will be issued in such circumstances.
• You are responsible for ensuring the accuracy of all information provided at the time of registration, including contact details. We cannot be held liable for issues arising from incorrect information.
• Proof of ticket registration (digital or printed) must be presented upon entry to the Event. We may also require photo identification to confirm you are the registered participant.

• All ticket prices are listed at the point of sale and are inclusive of any applicable taxes unless otherwise stated.
• Payment must be made in full at the time of booking. We accept the payment methods listed at checkout on the Registration Form.
• Where concessionary, student, or group rates are offered, we may require proof of eligibility at the point of entry to the Event. Failure to provide such proof may result in you being asked to pay the difference or, at our discretion, refused entry without refund.

• If you provide us with notice of cancellation more than 7 days before the Event, we will provide a full refund, less any non-refundable booking or processing fees charged by our booking portal providers.
• If you provide us with notice of cancellation 7 or less days before the Event, we may not provide a refund, unless exceptional circumstances apply (see below).
• To request a cancellation, please contact us via [email protected] with your booking reference, or utilise the booking portal features of the Registration Form to manage your order (where available).
• We may consider refund requests for exceptional circumstances outside the standard policy, at our discretion, in cases of serious illness, bereavement, or other significant life events. Supporting documentation may be required.
• If we cancel or significantly alter an Event, we will notify you as soon as practicable and offer either a full refund or transfer to another event. We are not liable for any additional costs you may incur (e.g. travel).
• We are not liable for cancellations caused by circumstances beyond our reasonable control, including severe weather, natural disasters, government restrictions, or public health emergencies. In such cases, we will endeavour to offer a transfer or credit, though a full refund cannot be guaranteed.

• We reserve the right to make reasonable changes to details of an Event, including venue, schedule, speakers, or program, without prior notice. Where changes are material, we will notify ticket holders as soon as possible.
• In the event of significant changes that fundamentally alter the nature of the Event, ticket holders will be offered a full refund or transfer.
• Events held outdoors may be subject to variation due to weather conditions. We will proceed with outdoor events wherever it is safe to do so. No refund is available solely because of weather conditions unless the Event is cancelled by us.

• All participants are expected to behave responsibly, respectfully and in accordance with law.
• We have a zero-tolerance policy towards behaviour that we deem is abusive, discriminatory, threatening, or disruptive to other participants, volunteers, our staff or the general public. Individuals who breach this policy may be removed from the Event without refund.
• In keeping with our environmental values, participants are asked to minimise waste at the Event, avoid excessive noise, use any bins provided and respect the natural environment at or near the Event venue.
• Unless the Registration Form specifies otherwise, all of our Events are drug and alcohol free. Smoking and vaping are only permitted in designated areas (if any) and are prohibited in natural or ecologically sensitive areas.
• Animals are not permitted at the Event unless they are registered assistance animals, or we have specifically stated that the Event is dog-friendly.

• The safety of our participants, volunteers, and staff is our highest priority. You must follow the instructions given by our staff and volunteers at all times during the Event.
• We strongly recommend that you wear appropriate clothing and footwear for the nature of the Event, particularly for outdoor or physical activities. We may restrict your participation in the Event if we believe there is a safety risk due to your attire or otherwise.
• You are responsible for assessing your own fitness and health before attending an Event. If you have any health conditions or mobility requirements, please contact us in advance so we can make appropriate arrangements. You must not attend an Event if you are sick with any contagious illness.
• You must inform us of any relevant medical conditions or special requirements at the time of booking or as soon as possible thereafter.
• Minors under the age of 18 must be accompanied by a parent or responsible adult at all times during the Event. We are not responsible for the supervision of minors at the Event.
• We are committed to making our events as accessible as possible. If you have accessibility requirements, please contact us prior to the Event and we will do our best to accommodate you.

• We may take photographs and videos at the Event for promotional, administrative, reporting and other purposes, such as publication on our social media channels, in our annual reports or newsletters.
• By attending our Event, you consent to being photographed and/or filmed whilst participating in the Event, for the above purposes, without compensation. If you do not wish to appear in our media, please notify us in writing prior to the Event.
• Do not record (i.e. take or broadcast substantial videos or audio recordings of large portions of the Event), unless we have provided you with prior written permission to do so. Any permission is granted subject to recordings being used for personal, non-commercial purposes only and provided you have obtained the express consent of any other participants captured in the recording. You are welcome to take photographs to capture memories of the Event subject to these same terms.
• At any time, we may require you to remove any material you have publicly posted in relation to the Event that is defamatory, offensive, infringes our intellectual property rights or otherwise.

• We may collect Personal Information from you in accordance with our Privacy Policy.
• To the extent you create or provide us with any Intellectual Property during the course of, or in connection with the Event, you grant to us (and our sub-licensees), a perpetual, royalty free, irrevocable, non-exclusive license to use that Intellectual Property, and you warrant that you have the right to grant this license. For example, this might apply if you provide us with photos or testimonials in relation to the Event.
• You consent to any act or omission with respect to the Intellectual Property above, that would otherwise infringe your Moral Rights therein. This essentially means we are able to modify and adapt your work for other purposes, and we are not required to identify you as the author in each case.
• If we provide you with access to any of our Intellectual Property, you are entitled to use it solely for the non-commercial purposes for which it was provided, during the Event, unless we advise you in writing otherwise.

• Depending on the nature of the Event, you may be exposed to certain risks. For example, an activity which is outdoors in nature carries risks of slips, trips and falls on uneven terrain, exposure to inclement weather conditions and contact with wildlife that could lead to bites or stings. By participating in the Event, you acknowledge and accept sole responsibility for any risks relevant to the Event and associated consequences. You hereby indemnify and hold us harmless for any loss or damage you or your invitees cause or contribute to in connection with the Event.
• We’re committed to taking all reasonable precautions to provide a safe environment for all participants at our events, but you do participate at your own risk. To the extent permitted by law, we disclaim, and you agree to release us from, any responsibility for any injury, loss or damage you incur in connection with participating in the Event. Where our liability cannot be fully disclaimed by law, we limit our total liability to you in connection with the Event to the total purchase price paid by you for your ticket to the Event. If you have any safety concerns, please raise them with us as soon as possible – we never want you to feel uncomfortable or unsafe!

• We may vary these terms from time to time. The version in force at the time you complete the Registration Form will apply to your booking for the Event.
• Nothing in these terms creates a legal partnership, joint venture, employer and employee or agency relationship.
• If any provision of these terms is found to be unlawful or unenforceable, it shall not affect the validity of the remaining provisions.
• You cannot assign your rights and obligations under these terms to another party.
• By agreeing to these terms, you warrant that you are 18 years of age or older or, if you are under 18, that you have parental/guardian consent to enter into this agreement.
• Clauses 8, 9 and 10 and clauses required for interpretation, survive termination or expiry of this agreement.
• This agreement constitutes a deed and is governed by the laws of Queensland, Australia. Any disputes that reach court will be heard in the courts of Queensland, Australia.

• When we use the following words with capital letters, here’s what we mean:

   

  Event	The ECOllaboration event or activity you are participating in, as identified in the Registration Form.
  Intellectual Property	Materials or content in any form (including but not limited to, pictures, photographs, videos, surveys, feedback, testimonials, written word, source code, layouts, designs, data, reports and audio files, inventions), and all present and future rights therein, whether issued or pending, registered or unregistered, including all forms of copyright, patents, trademarks, designs and trade secrets, any modifications and improvements thereto and all attaching statutory and common law rights.
  Moral Rights	Means rights of integrity of authorship, rights of attribution of authorship, rights not to have authorship falsely attributed, and rights of a similar nature conferred by statute, that may now exist or that may come to exist.
  Personal Information	Any information or opinion relating to or about an identified or identifiable natural person or about an individual who is reasonably identifiable.
  Privacy Policy	The ECOllaboration Privacy Policy accessible via our website.
  Registration Form	The document you complete to register for the relevant ECOllaboration event, such as an online ticket booking form made available by ECOllaboration on our website or a third party booking site such as Humanitix.
